Sentencing Guide to Oklahoma Felonies (2026)

Purpose

The Sentencing Guide to Oklahoma Felonies (“Guide”) is intended to be a practical companion to Oklahoma Criminal Law—Statutes & Rules—Annotated providing a quick and comprehensive reference to the penalty ranges, fines, penalty enhancements, fees, and other requirements for every Oklahoma felony all in one place.

Why?

The Oklahoma Sentencing Modernization Act of 2024, Laws 2024, c. 366, HB 1792 as amended by Laws 2025, c. 187, HB 2105, both effective January 1, 2026, classified more than 1070 felony offenses changing many of the former penalties, adding 15 new class designations and new penalty ranges, and more.  In addition, Laws 2025, c. 486, HB 2104, effective January 1, 2026, amended almost every Oklahoma felony offense to include language reflecting the new classifications and penalties.

Organization

The Oklahoma Sentencing Modernization Act (“Sentencing Act”) classified every felony within one of the 15 newly created classes.  Each felony offense is generally in numerical order within its classification.  As in the Sentencing Act, the Guide provides a table of each class listing each felony in the same numerical order as the Sentencing Act.  Every felony offense provides the following information, where applicable:

  • Citation and description of the offense;
  • Sentencing range—imprisonment and fine;
  • Second or subsequent conviction details for all offenses and of particular importance for Class C1, C2, D1, D2, and D3 felony offenses;
  • Violent crime per 57 O.S. § 571;
  • 85% minimum sentence crime per 21 O.S. § 13.1;
  • Enhancements (habitual offender and more) including: (1) Second and subsequent, violent and non-violent per 21 O.S. § 51.1; (2) Second conviction for first degree rape, sodomy, lewd molestation, and sexual abuse of a child per 21 O.S. § 51.1a; (3) Elderly and Incapacitated Victim’s Protection Program per 22 O.S. § 991a-16 et seq.; and (4) Penalty enhancement of weapon possession per 21 O.S. § 1287.1;
  • Cross references to related offenses and statutes;
  • Fees, Assessments & Other Requirements;
  • Editor’s Notes highlighting Legislative discrepancies and providing directions where possible.
